Security promise made to residents on 25th February 2007...not kept till yet. The money is with you...please provide security as said in this video than ask for more money in the name of security. Again the societies will take the public money from their account and give it to the federation and the federation will forget once again to provide the security. Should we keep our eyes and ears closed and allow the federation and the society to act at their whims and fancies?

If handful of people can come together to wake up the federation from their slumber then, imagine the difference it would make when all the residents put forth questions to the Federation or their respective societies?

Reply to CIDCO letter dated: 22 April 2008

Sub: Reply to your letter dated 22nd April 2008.
Dear Sir,
1. With reference to your letter dated 22nd April 2008 and subsequently displayed on the notice boards of the respective societies at Millennium Tower you are hereby informed that Millennium Tower residents have formed a committee named as Millennium Tower Residents Welfare Association,

2. Referring to the contents of your letter dated 22nd April 2008 which states and instructs the Millennium Tower Federation to depute security guard, has not been arranged till date. The federation of the Millennium Towers has not shown any interest over these years to safeguard the property that belongs to the residents, likewise now showing callous attitude towards the letter written by CIDCO dated 22nd April 2008 makes us to believe that Federation or any elected body has any interest in safeguarding the property stopping illegal activities.

3. In order to avoid further damages the welfare association has initiated the step to depute security personnel to safeguard the property of the residents at the clubhouse and swimming pool and the security is posted at club house and swimming pool by the elected said association.

4. Neither CIDCO or the federation has bothered or arranged to safeguard the property of the residents for the last three years, we the residents have to initiate appropriate action. Despite the Millennium Towers Symphony Co-op. Hsg. Society, had arranged cleaning the club hose and swimming pool thrice during monsoon it has not arranged to take care of the security because of so-called federation.

5. So far neither your representative as mentioned in your letter dated 22nd April 2008 has visited till date. So it goes without saying that neither CIDCO nor any elected body has any interest to take care of common property worth several crores or to take action for the thefts and damages taken place. Since no body has initiated to take care of the security and safety of the clubhouse and swimming pool or take any appropriate action through authorities, by lodging police complaint for the thefts taken place or providing security has utterly failed. So the residents have no alternative other than forming a committee elected by the residents to stop the illegal activities, thefts and damages. Therefore residents of millennium towers have selected and formed a committee which has arranged security for the clubhouse and swimming pool. The entire area has been cleaned thus keeping the outsiders and miscreants away from any access to this property after conducting a panchnama by the residents of the said residents. A copy of it is already submitted to managing director CIDCO signed by the said residents. Here in after you are requested to correspond and communicate with this welfare association with regard to the clubhouse and swimming pool.

An Appeal: Millennium Tower Residents Welfare Association (Prop.)

Residents of Millennium Tower have come together to form a welfare association titled Millennium Tower Residents Welfare Association [MTRWA] (Proposed), exclusively formed to manage and operate the day to day activities of the clubhouse and swimming pool.
The MTRWA has unanimously decided to request the residents to send in their names for membership for Clubhouse and Swimming pool before 30th May 2008.
An expertise committee is formed and would engage in assessing the total expenditure towards clubhouse and swimming pool for repairing and maintaince work caused due to the theft carried out since last over 3 years.
Since this clubhouse and swimming pool is covered under insurance for damages a police complain which was neither lodged by CIDCO or Millennium Tower Federation has been lodged with the Turbhe Police Station by the MTWRA to nab the culprits involved in theft and claim the insurance from the insurance agency if possible.
The representatives of MTRWA would approach the CIDCO officials shortly to install the electricity meter and water meter. CIDCO in their letters CIDCO has already mentioned that the electricity and water meters have been installed at the Clubhouse and Swimming pool, the payment towards it has been cleared by CIDCO to the vendor designated to install the meters.

Letter to CIDCO dated 27 March 2008

Dear Sir,
1) Vide letter No.CIDCO /MM/1 M.T/Sanpada/noc/334 dated 13th sap. 2002 Purchaser of Millennium towers, here in after the millennium towers may be addressed as the said society, was informed about the facilities provided in the said society the total sale price and details of apartment. .The said society has 1356 apartments constructed in 4 different types called as A,B,C,and D type.
Facilities assured in the said society by CIDCO
a) Land scaped gardens, play grounds, tree lined walk way/jogging track.
b) Spacious internal roads with adequate lighting and attractive street furniture.
c) Water fountains as focal points at road junctions.
d) Shopping mall
e) AN EXCLUSIVE FULL FACILITY CLUB HOUSE AND SWIMMING POOL
f) Sophisticated security booth with video monitoring facility at the entrance.
g) Two high speed lifts in each building
h) Standby D.G set for essential service.
2) CIDCO had assured the above said facilities in the brochure delivered to each purchaser of apartment in the said society. Most of the purchasers were significantly attracted to club house and swimming pool. So we the occupants were all happy and swiftly booked apartments keeping the best reputation of CIDCO in our mind in order to avail the club house and swimming pool facilities.
3) After having received the allotment letters of all apartments booked by purchasers CIDCO sent a letter vide CIDCO/MM 1 /MT /80003004/136 CIDCO INCREASED THE PRICE OF THE APARTMENT IN SAID SOCIETY WITH Rs. 100 (ONE HUNDRED)/SQ.FT. All the purchasers paid the escalated amount to avail the facilities of CLUB HOUSE AND SWIMMING POOL.
4) When all the purchasers from A4,A5,A6,A7,A8, and A9 buildings paid the entire amount the occupancy of the apartments was prolonged by CIDCO for more then a year and a half. This delay by CIDCO had put several honest purchasers into financial loss and inconvenience by paying hectic rents. However due to facilities provided by CIDCO the purchasers were bearing the financial loss and inconvenience .Purchasers from A4 to A9 started occupying the apartments in millennium towers from April 2005 onwards .At this point of period the construction of CLUB HOUSE AND SWIMMING POOL were noticed at the final stage .Most of the occupants and their family members who are eager in swimming and health oriented were enthusiastically expecting the commissioning of CLUB HOUSE AND SWIMMING POOL. CIDCO officials were constantly approached at various stage about the commissioning of CLUB HOUSE AND SWIMMING POOL. While receiving the ‘AGREEMENT OF SALE AND AGREEMENT’ the club house and swimming pool were at the final stage. Agreement sale para 4 reads ‘Corporation has given inspection to the purchasers of the original building plans and its specifications’. Nevertheless the allotees found the CLUB HOUSE AND SWIMMING POOL are not completed we expected the commissioning of the same in four months time. Therefore the purchasers who were living in rental houses could not afford to wait for another 4 months. The retired employees who were living in company quarters had to occupy the apartment immediately since the main requirement is the apartment and the club house and swimming pool could be availed in expected four months time. When the alottees received the occupancy certificate each member was issued with a maintenance manual that reads as CLUB HOUSE AND SWIMMING POOL ARE ALREADY EXIST. vide page 6 of project amenities. Therefore we were all happy to note that the club house and swimming pool would be available for usage in a very short time.
5) The construction of club house and swimming pool and installation of all fixtures , motors, a Diesel Generator set was exclusively installed for the purpose of club house and swimming pool and all project works were completed in 2005. The expenditure of the said project is the common fund collected by CIDCO from 1356 apartment owners of millennium towers societies. But the entire area is lying unattended for last three years. CIDCO authorities have not taken any initiative to look after the property lying unattended. Negligence and carelessness of CIDCO have led to the theft of the fixtures, doors, electrical appliances ,ceiling material. All glass doors and window pans are completely damaged by thieves . The total damages and theft taken place may cost several lakes. Who will bear the expenses to rectify the damages and who shall compensate the health loss incurred due to non availability of club house and swimming pool ?
6) CIDCO has charged Rs. 5786 ( five thousand seven hundred and eighty six only) as deposit from each purchaser before occupation towards the expenses for maintenance, repairs, management of the building, open areas , compound wall and common facilities as per para 9 page 4 of agreement, 10,000 ( ten thousand only ) for covered parking and Rs. 20,000 ( twenty thousand ) for stilt parking before occupation vide para 2 page 3 of agreement with CIDCO., . Rs. 8000 (eight thousand)for gas connection vide para 26 page 7 of the agreement
7) When the above said amount charged by CIDCO vide para 6,for the purposes and reasons mentioned thereof before occupation CIDCO had not ear marked an amount for membership to club house and swimming pool. Why? Car parking and gas connection are considered to be optional . But purchasers were forced to pay before occupation that too along with final payment..
8) Para 27, page 8 of agreement between CIDCO and the purchaser reads as ‘THE COPORATION HAS PROVIDED CLUB HOUSE WITH SWIMMING POOL AND OTHER FACLITIES SUCH AS GUEST HOUSE, SAUNA,JACUZZY,GYMNASIUM etc. If purchaser desires to avail this facilities by paying a sum as dicided from time to time by the corporation. The club house with swimming pool and other facilities will remain under control of corporation. ‘HAS PROVIDED’ means swimming pool and club house must be available for the use of purchasers and their families. Do they exist with water in swimming pool and health care equipment in the club house? ‘The payment will be decided from time to time’ Has CIDCO fixed any amount for last three years and sent a letter to purchaser as the case of car parking, gas connection and maintenance expenses for Rs. 10,000,8000 and5786 respectively?‘ Club house and swimming pool will remain under corporation control’ How long these two items should remain with corporation control and why?
9) Para 7 page 4”Any open space, lobbies, stair cases common terraces which will remain the property of corporation until the said land building are absolutely transferred to the said company/co- operative hsg. Society when formed. All the said common properties and facilities are handed over to Millennium Towers housing societies except club house and swimming pool. Why? There is not even a single water fountain in the entire millennium towers premises as promised in the agreement .Why?
10) Notwithstanding the CIDCO claims that it has provided club house and swimming pool in para 27 of agreement, physically that exit and practically that are not . This is like Sylock in merchant of Venice is asking a pound of flesh from the merchant for the money he lent who is not in a position to return. But the merchant agrees to give flesh as agreed but not even a drop of blood should drop from his body. Similarly CIDCO may also hand over both without a drop of water and health care equipment in swimming pool and club house respectively.
11) When CIDCO had already charged Rs. 5786 from each purchaser for maintenance and administration of common properties of millennium towers hsg. Societies why corporation had not arranged proper security and safety of club house and swimming pool. Major thefts have taken place from both the places and the property stolen may cost several lakhs and the replacement and repairing work may also cost many lakhs . A) Doors are tampered and stolen B) Glass doors damaged to gain access into club house vital areas. C)Electrical fittings appliances are tampered and stolen. D) Ceiling materials removed and stolen. An expert committee may be able to asses the cost of damages and theft.
12) . .(I, PD.Murthy, 0ccupant of A5/9/5 is a heart and back pain patient and my wife also is suffering from severe back pain and we are advised by doctors to have regular swimming. We had swimming facilities in our earlier quarters where we were staying. We both are senior citizens and we chose millennium towers society mainly for club house and swimming pool facilities. If we get the facilities we may lead a healthier life for another 20 years. But our expectations and assurances seem to be a mirage .Because we don’t see any symptoms to use the club house and swimming pool even after three and half years. Therefore I have for the reason mentioned afore taken this apartment to avail club house and swimming pool facilities. If the society is not able to arrange to function the same within a month society must arrange a swimming pool for myself and my wife with transportation facilities at the cost and consequences of the society My wife’s and my health are deteriorating because of non availability of swimming pool .)
13) The cognizance and the points mentioned from para 4 to 13 categorically establish that there seem to be ulterior motive and CIDCO is to be investigated if it has any malafide intention.
You are kindly requested to note the points and an appropriate action taken within a fortnight. Failing which a legal action may be initiated at the cost and consequences of the CIDCO. Thanking you.

For the people...of the people...by the people

Recent notices on the societies notice board at Millennium tower disregards the onus and initiative to rightfully handover the clubhouse to its residents. There could be different groups/individuals (please remember that they are the residents and not any outsiders) working towards the cause for which the federation would be fighting for years. So your force to represent Millennium Tower residents to CIDCO has grown in numbers. But it seems that the Federation dislikes the idea of other individuals/ groups to follow up for the right cause. The objective of the Federation and different individuals/ groups is to commission the clubhouse and residents are able to enjoy the facilities that was agreed upon by CIDCO before handing over the flats. CIDCO has entered into an agreement with every individual to whom the flats were sold.
There is no agreement between CIDCO and Federation that it would be handedover to the Federation.
To remind the residents, a year ago Federation had collected Rs. 500/- per flat towards Gas Supply Deposit and Rs. 50/- per month for providing common security. It is over a year now and still the money that was collected by taking residents in confidence has not been met. People in the society had approached the Federation to provide receipts of payments received from them but there is no receipt that is issued to them. Thus such residents have stopped paying the gas bills and they are still enjoying the service without any disruption. Questions that comes to my mind is are we being overcharged than the prescribed market price to meet the bills that is unpaid by the residents?
I guess 50% of residents paying the gas bills for the 50% not paying it.
Federation committee please come forward and explain...remember your existence is respective societies representation and you are answerable for every action that is being taken.

My agreement reads as...what does your agreement read?


Read the para 27. of the Agreement of Sale between you as a purchaser and CIDCO as the builder of this complex.
Read para 30. which clearly states that FSI is fully consumed and the clubhouse and swimming pool is well considered within the stated FSI.
My comments on para 27. I understand that Corporation (CIDCO) has already provided me with a Clubhouse and Swimming pool the facility right from day 1 I took possession of the flat. It also mentions that this property would remain under CIDCO and CIDCO as the authority would be deciding the fees time to time.
~Where does the question of handing over comes when this facility was already provided from day 1. ?
~Well do the federation has some interest in taking over the charge of this clubhouse and other facilities?
~Do the members of Federation qualifies to become the member and avail this facility without any obligations?
With time more questions would come to every individual minds. Lets us discuss it out here...if you guys can think of any questions that may come to your mind.

Voluntary Contributions

Fixing of broken doors is of utmost importance to avoid unauthorised public access to the clubhouse. Thus, we invite voluntary contributions from the residents of Millennium Tower.
We urge the residents to come forward and support the cause.

SUB: ENERGY AND WATER METER AT MILLENNIUM TOWERS
CLUB HOUSE AND SWIMMING POOL.

Dear Sir,
It is understood that the CIDCO had an agreement with the contractor (Contractor Name) to provide energy and water meters from MSEB and NMMC respectively to club house and swimming pool in Millennium Towers at Sector 9, Sanpada Navi Mumbai. Your tender agreement to provide the said meters in club house and swimming pool was fixed as 31st April 2005 by you.
You had offered the contract to commence from 31st Dec 2004, with an agreement to complete the entire work by 30th April 2005 before handing over the club house and swimming pool to the tenants.
You have paid the cost and expenditure for procuring energy, water meter and the required connections from MSEB and NMMC respectively. The total expenditure for the said work is covered under contract sum. But it is surprised to note that the said meters and connections are not provided in Millennium Towers club house and swimming pool till date.
Therefore you are requested to arrange to provide the said meters within 24 hours to facilitate Millennium Towers residents to have lights in the club house.
We ventured to enquire with the contractor to find the reason for the lapses at the address registered with CIDCO that is maruti mount view,sector 8/B, CBD Belapur, Navi Mumbai it was found to be a residential flat and office of the contractor and tele phone numbers given in letter head do not exist
So Sir kindly arrange to provide meters for energy and water as requested above

The history dates back to 4 years ago...

It is over 4 years CIDCO is dilly dallying the handing over of the Clubhouse at the Millennium Towers. The Millennium Tower Federation has been following up with CIDCO authorities to commission the Clubhouse. But the for reasons best known to CIDCO it is constantly delaying this handover. But if we read our Agreement of Sell copies which we signed with returning one copy to CIDCO the para related to Clubhouse clearly reads as CIDCO has already provided a clubhouse (which is provided but without the required equipments with only the structure). CIDCO would manage this facility by levying fees time to time which would be collected form the clubhouse members. But CIDCO has failed to provide such facility.

On 12 April 2008, Mr. Dhanus Murthy and the representatives of the Millennium Tower Federation had a discussion concluding with a promise from the Millennium Tower Federation representatives that Clubhouse would be handed over next day with a formal letter from CIDCO, but till date no news about it.

Mr. Dhanus Murthy has initiated the endeavor of rightfully handing over of clubhouse from CIDCO to its rightful owner. The first meeting was held on 19 April 2008, with almost over 100 residents attending this meeting. The future course of action would be decided upon soon.
